EU Battery Regulation 2023/1542 Timeline: Exporters, Mark These Dates
If you export batteries to the EU, you've heard of Regulation 2023/1542. But a lot of people treat it as a single deadline — "it took effect in 2023, done." The reality: it's a phased calendar. Different battery types and different obligations each have their own cutoff. Miss one date and your shipment can sit at customs.
First, the key milestones
- 2023-08-17: Regulation entered into force
- 2024-02-18: Main provisions started applying
- 2024-08-18: Formally replaced the old Battery Directive 2006/66/EC; CE marking and conformity assessment kicked in
From this date, selling batteries in the EU is no longer under the old rules — it's the new regulation.
Three calendars to memorize
1. Carbon footprint
Carbon footprint requirements phase in per battery type — methodology first, then limits:
- EV batteries: methodology delegated act due 2024-02
- Industrial batteries (without external storage): 2025-02
- LMT batteries (light means of transport, e.g. e-bikes): 2027-02
- Industrial batteries with external storage: 2029-02
Notice the cadence: first the "how to calculate" methodology, later the mandatory declaration and limits. Don't rush a full carbon footprint report now — first confirm which phase your battery type is in.
2. Due diligence
Supply chain due diligence (cobalt, lithium, nickel not sourced from conflict zones) is also phased. Core obligations roll out around 2025-08-18, targeting operators placing batteries on the market. This one is easy to overlook — it doesn't audit your product testing, it audits your supply chain management.
3. Battery passport — the easiest to miss
Article 77 states plainly: from 18 February 2027, these batteries must carry an electronic battery passport when placed on the market:
- LMT batteries
- Industrial batteries with capacity above 2 kWh
- All EV batteries
A battery passport isn't a sheet of paper — it's an electronic record with battery-model information plus individual-battery data (usage history, state of health). By 2027, no passport = no EU market access.
Timeline in one table
| Date | What happens |
|---|---|
| 2024-08-18 | Replaces old directive; CE marking + conformity assessment |
| ~2025-02 | Carbon footprint methodology (industrial batteries) |
| 2025-08-18 | Supply chain due diligence obligations roll out |
| 2027-02-18 | Battery passport (LMT / industrial >2 kWh / EV) |
| 2027-2029 | Carbon footprint declarations become mandatory per type |
Practical advice for exporters
- Identify your battery category first — EV, industrial, LMT, portable? Each has a different timeline.
- For products after 2024-08: CE marking + DoC is the baseline — confirm yours is done.
- 2027 is the next wall: the passport requirement seems far off, but data collection (model + individual info) has to be designed in advance — you can't scramble to catch up.
- Don't only watch testing: due diligence audits your supply chain — ask upstream suppliers for sourcing proof early.

FAQ
When does EU Battery Regulation 2023/1542 fully apply?
The regulation took effect 2023-08-17, main provisions applied 2024-02-18, and it replaced the old Battery Directive 2006/66/EC on 2024-08-18. But carbon footprint, due diligence and battery passports phase in over years, fully landing by 2029.
When is the battery passport required?
From 18 February 2027, every LMT battery, every industrial battery above 2 kWh, and every EV battery placed on the market must carry an electronic battery passport.
When does carbon footprint declaration start?
By battery type: EV batteries 2024-02 (methodology), industrial (non-external storage) 2025-02, LMT 2027-02, industrial with external storage 2029-02. Declarations tighten over time — first methodology, then mandatory declaration, then limits.
